IN THE HIGH COURT OF DELHI AT NEW DELHI

+ BAIL APPLN. 1400/2017 NEERU SANYAL ..... Petitioner Through:

Mr. B.S. Arora, Adv.

versus STATE NCT OF DELHI ..... Respondent Through:

Mr. Amit Gupta, APP for State with SI Bharat Lal, P.S. Hauz Khas.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 24.07.2017 Keeping in view the specific allegations by the complainant that on the assurance of petitioner that the property, mortgaged vide registered mortgage deed, was free from all encumbrances while taking loan, inasmuch as, the fact that in the mortgaged deed itself it was mentioned that 'property was free from encumbrances' even though, property was mortgaged by the petitioner with the bank prior to creation of the mortgage, I am not inclined to extend the benefit of anticipatory bail to the petitioner. Bail application is dismissed. Miscellaneous applications are disposed of as infructuous.

A.K. PATHAK, J.
