% 22.02.2016 The present revision petition has been filed by the petitioner to challenge the order dated 7th April 2015 passed by Special Judge (PC Act) (CBI)-06, Patiala House Courts, New Delhi whereby the appeal filed against the order passed by learned Metropolitan Magistrate in CC No.25/4/2014 under Section 23 of the Domestic Violence Act was dismissed.

The learned counsel for the petitioner submits that the petitioner has already entered into the settlement with the respondent and in consequence, the respondent has withdrawn the proceedings in which the impugned order was passed. Since the main petition has already been disposed of, therefore the impugned order does not survive. Therefore Counsel for the petitioner seeks permission to withdraw the present petition.

In view of the aforesaid the present petition is dismissed as withdrawn.
