% 06.08.2018 Learned counsel for respondent No.1 has been handed over a cheque in the sum of Rs.1,25,000/- bearing No. 005321 dated 04.08.2018, drawn on Bank of Baroda, SSI NOIDA, Noida-201301. In view of the above, learned counsel for respondent No.1 says that in case the cheque is honoured, no claim would survive qua the petitioner.

Accordingly, for the moment, the petition is closed. I may also record that learned counsel for respondent No.1 has indicated to this Court that if the aforesaid cheque is honoured, respondent no.1 will also withdraw the arbitration proceedings, which are pending adjudication before the learned Arbitrator. The said statement is also taken on record.
