% 25.08.2015 Mr.M.P. Singh, learned APP files the status report today in the court. Learned counsel for the petitioner seeks anticipatory bail in connection with the FIR No.279/2015 dated 07.06.2015 instituted for the offence under Sections 452/323/506/34 of the IPC. The petitioner is stated to be one of the partners of a company of builders which is run under the name and style of PGC & Company.

The complainant is one of the flat owners. There is a dispute with respect to the parking space in the multi-storey building which has been constructed under the aegis of PGC & Company and in which building the complainant has a flat.

The allegations in the First Information Report is that with respect to such dispute, the complainant and another were assaulted. It has also been

alleged that some of the accused persons called for other persons also who assaulted the informant and others.

From the FIR itself, it would appear that the injuries suffered by the informant and others were of a very trivial nature. In fact, the informant was not willing to get his MLC done.

It has been submitted on behalf of the petitioner that similarly situated co-accused person has been granted the privilege of interim bail by the Court below.

Considering the above facts, let the petitioner be released on bail, in the event of arrest, on his furnishing a bond of Rs.25,000/- with two sureties of the like amount, to the satisfaction of the Arresting Officer cum SHO of the concerned police station, subject to the condition that the petitioner would join the investigation as and when required by the Arresting Officer / SHO of the concerned police station and would not cause any impediment in the police bringing the investigation process to a logical conclusion. Application is disposed of accordingly.
