O R D E R

% 19.12.2016 Arguments heard.

The present application has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in FIR No.420/2016, under Section 323/341/308/34 IPC, Police Statiion Chhawla. As per FIR, the allegations levelled are that the complainant Vijender Pal Singh stated in his statement made to the police that on 17.11.2016 at about 03.00 p.m., he was present in his house. One tractor having a wooden board came and hit the stock of bricks outside his house.

When the complainant tried to stop the petitioner/accused who was driving the tractor at that time, he came down and gave a slap to the complainant. On hearing this, son of the complainant, namely, Devender Kumar came for his rescue. In the

meantime, brother of the petitioner, namely, Kochan and some more boys came there on a motorcycle and Kochan gave beatings to the son of the petitioner with a danda. The person riding the motorcycle hit the complainant on his forehead with a brick due to which he fell down.

As per the allegations, role attributed to the petitioner is that he gave slap to the complainant and then gave beatings to him and his son.

The injury which is alleged to have been caused to the complainant and his son on their head, are not attributed to the petitioner.

In view of the above mentioned facts and circumstances, the application is allowed. It is hereby ordered that in the event of arrest of the petitioner, he be released on furnishing the personal bond in the sum of Rs.15,000/- with one surety in the like amount to the satisfaction of the arresting officer. The petitioner is directed to join the investigation as and when directed.

He is also directed not to tamper with the evidence and influence the prosecution witnesses. He is further directed not to leave the country without prior permission of the Court concerned.

The present bail application is disposed of accordingly. P.S.TEJI, J DECEMBER 19, 2016 dd
