O R D E R

% 09.03.2019 Parties have mutually agreed to resolve the subject matter and thereunder, the respondent Insurance company has agreed to pay a sum of Rs. 1,45,000/- (Rupees One Lakh Forty Five Thousand only) over and above the amount payable in terms of the impugned award towards full and final settlement. Such additional sum of Rs.1,45,000/- shall be deposited with the DHCLSC by the Insurance company within four weeks, failing which, it shall carry interest @ 9% p.a. on the delayed deposit. The settled amount be released in consonance with the terms of the award.

Parties have also mutually agreed that the claimant shall be at liberty to approach MACT for the release of the amount (s) as the exigencies may require, which shall be duly considered.

The impugned award stands modified to that effect. Consequently, the appeal shall stand disposed of accordingly.
