Vide order dated 31.05.2019, the predecessor bench accepted the contention of the petitioner management and directed the respondent no.1, the legal representative of the deceased workman to file a claim under Section 75 of the ESI Act. But instead of disposing of this petition, the predecessor bench kept it pending and directed the Employees Insurance Corporation to send the record to this court after deciding the matter. Thereafter, the matter kept getting adjourned for one or the other reason and has come up before me today for the first time. It is informed by learned counsel for respondent no.3/ESIC that claim of the respondent no.1 already stood allowed way back in September 2022.
