% 28.08.2017 Issue notice. Counsel for the petitioner accepts notice. Learned counsel for the respondent has prayed for early hearing of the matter. Counsel for the petitioner is agreeable with the same. Both the counsels have consented to the final disposal of the case and accordingly the same has been heard. After some arguments, it is agreed that the respondent‟s grading of „Good‟ for the period 01.09.2008 to 31.03.2009, with the representation made by the respondent in response to the notice issued to the respondent be again placed before the review DPC for reconsideration of the case of the respondent for grant of non-functional grade. It would be for the DPC to consider the aforesaid aspects and to arrive at a decision whether or not to grant non-functional grade to the respondent. The said exercise be undertaken within eight weeks.
The impugned order passed by the Central Administrative Tribunal, Principal Bench, New Delhi in OA No.2902/2015 dated 20.03.2017 is accordingly set aside and substituted with these directions.
