IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 4991/2018 SUBHASH CHAND ..... Petitioner Through:

Mr.R.K.L. Choudhary, Adv.

versus THE STATE ( NCT OF DELHI) & ANR ..... Respondents Through:

Ms. Kusum Dhalla, APP for State with SI Sanjeev, P.S. Tilak Marg.

Respondent no.2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 05.10.2018 Respondent no.2 is present in Court and has been identified by SI Sanjeev of police station Tilak Marg of police station Tilak Marg. Respondent no.2 says that she has settled the matter with petitioner of her own free will and without any undue force, pressure or coercion. She further submits that petitioner has also compensated her by paying ₹10,000/- towards the mental trauma suffered by her. She has no objection in case FIR No. 47/2016 under Sections 354D/509 IPC registered at police station Tilak Marg is quashed.

Affidavit of respondent no.2 in this regard is also on record.

Keeping in mind the settlement arrived at between the petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be

served in keeping the FIR pending.

Accordingly, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.

Dasti.
