O R D E R

% 24.08.2017 W.P.(C) 6175/2017 Learned counsel for the parties agree that the Vice-Chancellor of the Delhi University should consider the communication dated 28th January, 2016 of the Chairman of the Governing Body and pass appropriate orders. Mr. Anurag Mathur, learned counsel appearing for the respondent no.4 states, even though the Governing Body has not heard the respondent no.4 herein before seeking approval of the Vice-Chancellor vide the communication dated 28th January, 2016, the right of the petitioner to take such objection, if need arises in future, be kept reserved. Ordered accordingly.

Mr. Mohinder J.S. Rupal, learned counsel appearing for the

respondent University states that pursuant to the communication dated 28th January, 2016, a Committee was constituted by the Vice-Chancellor. Mr. Avadh Kaushik, learned counsel for the petitioner and Mr. Anurag Mathur, learned counsel for respondent no.4 acknowledge this submission of Mr. Rupal and state that the Committee has sought clarification from the petitioner union and the comments of the respondent no.4. It that be so, Vice-Chancellor shall take decision on the communication dated 28th January, 2016 within four weeks by considering the report of the Committee (if any) which considered the clarification and the comments from the petitioner and the respondent no.4 respectively. Party aggrieved by the decision of the Vice-Chancellor shall be at liberty to seek such remedy as available in law. The decision taken shall be communicated to the petitioner as well as to the respondent nos. 2 to 4.

The petition stands disposed of.

A copy of this order be given dasti under the Signatures of the Court Master.
