O R D E R

% 18.01.2017 Learned counsel appearing on behalf of the parties, state in unison, that the underlying dispute that led to the institution of the present petition has been amicably settled by and between the parties with the aid and assistance of Delhi High Court Mediation and Conciliation Centre. The terms and conditions of the settlement are enshrined in the settlement agreement dated 17.10.2016. Learned counsel appearing on behalf of the petitioner states that in pursuance to the aforesaid settlement agreement, they have received post-dated cheques from the respondent-company.

Mr. Gaurang Kanth, learned counsel appearing on behalf of the respondent-company undertakes that they shall maintain sufficient funds to ensure that the aforesaid cheques are duly encashed and honoured on their presentation.

The above said settlement agreement dated 17.10.2016 entered into between the parties herein is lawful and the same is taken on record. The

parties shall abide by the terms and conditions of the said Settlement Agreement dated 17.10.2016, without demur.

In view of the foregoing, learned counsel appearing on behalf of the petitioner seeks leave to withdraw this petition. Leave granted.

The petition is dismissed as withdrawn and disposed of accordingly. Pending application also stands disposed of.
