% 15.10.2019 This appeal is against the judgment and decree dated 09.07.2018 passed by learned Additional Distrcit Judge-02, South West, Dwarka, Delhi in Suit No.426783/2016.
The matter has been amicably settled between the parties vide the settlement agreement dated 16.03.2019 before the Delhi High Court Mediation and Conciliation Centre, more specifically in terms of para 1 to 11 of the said agreement. It is agreed on compliance of the conditions above there shall be no further claim, demands against each other and all the disputes and differences shall stand amicably settled between the parties.
The learned counsel for the appellant says the amount stated therein has been paid to the respondent and the respondents were to return the original title documents, per clause 7 of the settlement agreement. The respondent no.l is present in person and accepts the
receipt of money and assures the return of original title deeds/documents to the appellant within a week from today. The learned counsel for the appellant now intends to withdraw the appeal. In the circumstances, the appeal stands disposed of in terms of the settlement agreement dated 16.03.2019. The parties shall be bound by its terms.
The Court fee paid by the appellant shall be refunded as per the provisions of the Court Fee Act, as the matter has been amicably settled between the parties in the mediation. YOGESH KHANNA, J.
