W.P.(C) 7219/2017 Status report has been filed by the respondents. Page 2 of the status report reads as under:

"In view of the aforementioned provisions, the petitioner although violated and misrepresented the renewal status of his driving license, in view of Rule 18 as he was residing in Delhi for the past more than 9 years and got his license renewed from RTO, Mumbai (Central) which attracts serious action including cancellation of the driving license u/s 19 of Motor Vehicles Act, 1988. However, that the license may be renewed subject to compliance of aforementioned rules by the petitioner whereby he is required to deposit the fees as specified in Rule 32 of CMVR along with an application in Form 9 with the test of

competence to drive specified motor vehicles conducted by any of three institutes, i.e., IDTR / DTI. He is further required to undergo two days refresher training at any of the given centre."

From the reading of the status report, it is transpired that the respondents shall renew the licence of the petitioner subject to petitioner depositing a fee as specified under Rule 32 of CMVR along with an application in Form 9 with the test of competence to drive specified motor vehicles conducted by any three institutes, i.e., IDTR / DTI and undergoing two days refresher training.

Mr. V.N. Jha, learned counsel appearing for the petitioner states, petitioner has already submitted the application in form 9. He also states, the fee shall be deposited; and he shall appear in the competency test and undergo refresher training. Mr. Santosh Kr. Tripathi, learned ASC appearing for the respondents states, necessary communication shall be sent to the petitioner for deposit of the fee and appearance in the competency test / refresher training within 10 days from today. If that be so, petitioner shall appear before the concerned authority for completing the formalities for renewal of licence. Mr. Jha states, aforesaid shall satisfy grievance of the petitioner and the petition may be disposed of. Ordered accordingly. V. KAMESWAR RAO, J FEBRUARY 08, 2018/jg
