By way of this application filed under Section 439 Cr.P.C., the petitioner has applied for bail in case FIR No.92/2010, under Section 302/201/120B/34 IPC, PS Nihal Vihar for the reason that he wants to get his children admitted in another school where the tuition fee would be comparatively low as his family is unable to bear the tuition fee burden of the school where presently his children are studying. He needs bail to arrange money for the admission of his children to a new school. 2.

The status report has been submitted by the State which reads as under:

"As per inquiries conducted, it is found that applicant's two sons namely Siddharth and Sujan are studying in 6th and BAIL APPLN. 1375/2017

4th class at Parkash Bharati Public School and it is situated less than 1⁄2 k.m. from the house of the applicant. Both are paying monthly fees at ₹1100/- and ₹1000/- respectively. The New Saraswati Public School is situated about 5 k.m. from applicant's residence. The fees for 6th Class is ₹1390/- and for the 4th class, it is ₹1200/- per month and the EWS category is upto 5th class. The admissions are upto July end. Smt.Bharati Devi (wife of the applicant) could not tell any specific reason for transfer of the children to new school." 3.

Considering that the reason given by the petitioner for shifting the school cease to exist as the fee in Parkash Bharati Public School where his children are studying, is 1⁄2 km. away i.e. walking distance, tuition fee in this school is lower than in New Saraswati Public School which is at a distance of 5 kms. from his residence.

In view of the above report, I do not find any ground to release the petitioner on bail for the purpose of shifting of the school of his children. 5.

The bail application is dismissed.
