O R D E R

% 24.04.2017 C.M. No.4756/2017 (for seeking further directions by respondents) 1.

This is an application for modification of the order dated 25.1.2017 disposing of the appeal as per the compromise, and it is prayed that besides the appellants even the mother of the appellants Smt. Pushpa Sharma be directed to give an affidavit of undertaking to vacate the suit premises.

Counsels for the parties agree and accordingly this application is disposed of with the consent order that Smt. Pushpa Sharma will now file her affidavit within three days from today to vacate the suit premises FAO No.581/2016

alongwith the present appellants on or before 30.6.2017, and it is further agreed that the respondents have agreed not to claim mesne profits with respect to the suit premises in terms of the impugned judgment and decree subject to the suit premises being vacated by the appellants and Smt. Pushpa Sharma on or before 30.6.2017. It is also agreed that once the possession of the suit premises is received by the respondents from the appellants and Smt. Pushpa Sharma in terms of the present order, then, thereafter the respondents will withdraw their execution petition pending before the executing court. 3.

C.M. stands disposed of.
