% 21.07.2017 After some hearing, learned counsel for the petitioner seeks permission to withdraw the present writ petition in view of what is stated in the impugned letter of rejection dated 7th July, 2017, the operative portion of which reads as under:- "3.

Moreover, the purpose to grant study leave to Government Servant is to help acquire greater competence. The rating of Camellia Institute of Polytechnic is not known. Prospectus of the institute for the proposed course and admission letter/letter of acceptance of candidature of the official in the institute are also not available. It is not understood whether in the opinion of DGBR, pursuing the Diploma Course from the said institute will add desired value. It may also be kept in view that perhaps Dte GBR in the organisational interest regularly sponsors its officials for pursing Diploma from CME, Pune."

Learned counsel for the petitioner states that he would collect necessary documents and papers and the petitioner would thereafter move a fresh application for study leave.

We clarify that we have not expressed any opinion on merits and if any fresh application is filed, the same would be considered by the respondents in accordance with law.

The writ petition is accordingly dismissed as withdrawn. Dasti under signature of the Court Master.
