Vide the present petition under Section 482 Cr.P.C., the petitioners seek quashing of the FIR No.458/2016, registered under Section 509 IPC at Police Station Kalkaji, on the basis of settlement dated 30th August, 2018.

At the outset, Ms.Manjeet Arya, learned APP submits that in the present case, even though the chargesheet has been filed under Section 509 read with Section 506 read with Section 34 IPC, the offences are compoundable since the petitioner is alleged to have committed an offence under Section 506 Part I IPC and not Part II thereof which is compoundable 3.

In view of the aforesaid statement made by learned APP, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to approach the learned Trial Court to seek compounding of the offences.

The petition along with pending application are dismissed as withdrawn with liberty as prayed for.
