By this petition the petitioner seeks quashing of FIR No.697/2015 under Sections 420/467/471/120B/471 IPC registered at PS Safdarjung Enclave, New Delhi on the complaint of respondent No.2, that is, Dewan Housing Finance Corporation (DHFL).

Learned Additional Standing Counsel for State submits that the victim in the above noted FIR is not only DHFL which has been impleaded as respondent No.3 and its authorised representative as respondent No.2 but also one Dharmender for the reason signatures on the NOC which was handed over to respondent No.4 Dharmender for the purpose of utilisting and transferring the property are allegedly forged. Learned counsel for respondent No. 4 Dharmender is present along with Dharmender. He states that there is no settlement arrived at between the parties.

Learned counsel for the petitioner states that Dharmender is not a victim but an accused in the FIR.

Be that as it may, since there is no holistic settlement at this stage, learned counsel for the petitioners seeks leave to withdraw the petition with liberty to file a fresh petition in case a holistic settlement is arrived at between all the complainant/victims.

Petition and application are dismissed as withdraw with liberty as prayed for.
