O R D E R

% 27.11.2017 After some hearing, the learned counsel for the petitioner submits, on instructions from the petitioner present in person, that the revision petition against the eviction order which is impugned herein, may be allowed to be withdrawn, though the request pressed is for some time to be given for vacation of the demised premises. On this request which was made in the pre-lunch session, the parties - the respondent also being present in person with the counsel - were given time to sit together with their respective counsel and reach an amicable resolution.

When the matter is taken up in the post lunch session, the learned counsel on both sides jointly submit that the parties have agreed that petitioner would hand over the vacant possession of the premises in question on or before 30.06.2018, with undertaking to the

effect that he would clear the arrears of rent within two months and that he shall continue paying the user charges equivalent to the rate of rent, for the period he remains in occupation, and further that he would not create any third party interest during the interregnum. Subject to undertaking to the above effect being furnished before the Rent Controller within a week hereof and subject to strict and scrupulous compliance with such undertaking, the time to vacate and hand over the demised premises on or before 30.06.2018 is hereby granted to the petitioner and the petition is dismissed as withdrawn affirming the eviction order.
