% 03.10.2018 Petitioner seeks interim bail for two months on the ground that his wife is ailing and is to be operated upon at Deen Dayal Upadhyay Hospital, District Muradabad, U.P. State has verified the factum of illness of petitioner's wife and that she has to be operated upon. Learned APP submits that petitioner's daughter is aged 19 years and his son is 17 years old and they can look after their mother. It is further submitted that petitioner is involved in an NDPS case registered at police station Faridpur, Bareilly, UP and he is also an accused in case registered under MCOCA at Special Cell. Learned counsel for petitioner submits that Barielly case was registered in the year 1996 and petitioner has already been acquitted in that case. He further submits that petitioner will furnish a local surety.

Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety living in Delhi in the like amount to the satisfaction of the trial court.
