O R D E R

% 09.10.2018 By this petition under section 482 Cr.P.C., petitioner has prayed for grant of regular bail. It is submitted that petitioner was working as a nursing orderly in Chacha Nehru Bal Chekitshalya (CNBC), Geeta Colony Delhi where deceased was working as a staff nurse. Petitioner was not the supervisory authority of deceased. In the suicide note, deceased has alleged that petitioner used to trouble her. She used to backbite against the doctors and other staff; She used to instigate the deceased against her family members also. The deceased committed suicide at her matrimonial home. Deceased was suffering from depression as her child was ailing. In the suicide note there is no mention of events / acts of petitioner that could constitute abetment to commit suicide by the deceased. Suicide notes are undated. There is nothing to conclude that suicide notes were written immediately before the deceased committed suicide.

Learned APP, who is assisted by learned counsel for the complainant, submits that the deceased has categorically stated that petitioner used to ask money from her and had even taken `1.50 lacs from her which amount was not returned by the petitioner. It is contended that petitioner was in good books of the Director and by taking advantage of this fact, she used to trouble the deceased. Petitioner is in custody for the last about 4 1⁄2 months. Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms.
