This petition under Article 227 of the Constitution of India impugns the order (dated 12th May, 2017 in Suit No.12498/2016 of the Court of Additional District Judge-11 (Central District), Tis Hazari Courts, Delhi) impleading the petitioners No.1&2 as defendants in a suit filed by the respondents/plaintiffs against the petitioners No.3&4 herein for specific performance of an agreement of sale of immovable property. 4.

It is not in dispute that the petitioners No.1&2 are the subsequent purchasers from petitioners No.3&4.

Upon attention of the counsel for the petitioners being drawn to Sumtibai Vs. Paras Finance Co. (2007) 10 SCC 82 and Mumbai International Airport Private Limited Vs. Regency Convention Centre and Hotels Private Limited (2010) 7 SCC 417 being judgment subsequent to Kasturi Vs. Iyyamperumal (2005) 6 SCC 733 , the counsel for the petitioners/defendants withdraws the petition. 6.
