RC.REV. 602/2016 &CM No. 46697/2016 (stay) The learned counsel for the petitioner has made submission. Thereafter, he submits that if six months time is granted to the petitioner to vacate the property in question, he would not press the present petition. He undertakes on behalf of the petitioner that the petitioner would vacate the property in question, i.e. shop situated on the ground floor being No.G-10, Hauz Khas Enclave, New Delhi as described in the eviction petition on or before 30.06.2017. He also undertakes that the petitioner shall continue to pay agreed rent, electricity and water charges of the property in question for the period the petitioner occupies the property in question. The petitioner

shall also not part with possession of the property in question or cause any wilful damage to the property in question. The petitioner also admits the ownership/bonafide need of the respondent.

The petitioner shall file an affidavit of undertaking on the above terms within a period of two weeks from today. The petitioner shall remain bound by the terms as above.

In view of the above, the present petition is dismissed as withdrawn. The learned counsel for the respondent submits that in view of the undertaking/affidavit of the petitioner, his client shall not execute the eviction order till 30.06.2017.
