This petition was filed on behalf of the Petitioner under Article 227 of the Constitution of India assailing order dated 14.05.2018 passed by learned Additional Sessions Judge, Dwarka, New Delhi in revision petition being CR No. 252/2017 as well as order dated 29.04.2017 passed by learned MM01, Dwarka Courts, Delhi. Petitioner had filed an application under Section 156(3) Cr.P.C. which was dismissed by the learned Trial Court and taking cognizance of the offence, Complainant was directed to examine himself and his witness under Section 200 Cr.P.C. Matter was adjourned for presummoning evidence. Petitioner challenged the order in a revision petition, which was dismissed and the impugned order dated 29.04.2017 was upheld. 2.

Learned counsel for the Petitioner, at the outset, states that this petition is rendered infructuous since pre-summoning evidence is being recorded before the Trial Court and be accordingly disposed of. 3.

Petition is disposed of as infructuous.
