CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 12.10.2018 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2-Surender is present in Court and accepts notice. He has been identified by SI Anil of police station Kanjhawala. It is submitted that petitioners and respondent no.2 have settled their disputes amicably before Delhi Mediation Centre, Rohini District Court, Delhi vide Settlement / Agreement dated 7th June, 2018.
Respondent no.2 admits that he has settled the matter with petitioners of his own free will and without any undue force, pressure or coercion in terms of settlement and that he has no objection in case FIR No.34/2013 under section 420/468/471 IPC registered at police station Kanjhawala and the consequent proceedings are quashed against the petitioners.
Keeping in mind the settlement arrived at between petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.
Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed against the petitioners.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J OCTOBER 12, 2018 sm
