versus UNION OF INDIA ..... Respondent Through Mr. Jagjit Singh, Sr. Standing Counsel

CORAM:

HON'BLE MR. JUSTICE RAJIV SHAKDHER

O R D E R

% 26.09.2018 1.

Issue notice. Mr. Singh accepts notice on behalf of the respondent. 2.

Learned counsel says that he does not wish to file a reply as the prayer made in the petition is limited.

3.

The only grievance of the petitioner is that the quantification of claim no.14 in the main award is incorrect.

4.

In the impugned award, claim no.14 has been quantified at Rs.36 lacs, whereas it should have been according to the petitioner quantified at Rs.73,13,175/-. The basis for this calculation is given in Ground A of the petition. The calculation sheet is appended as Annexure P-1 at page no. 99 of the documents.

5.

Having regard to the submission made by the counsel for the parties, I am inclined to set aside the award to the extent it relates to claim no.14 and remit the matter to the learned Arbitrator for re-examining the calculations O.M.P. (COMM) 408/2018

made by him.

I.A. No. 13195/2018 6.

This is an application for condonation of delay of 22 days in filing the petition.

7.

For the reasons given therein, the delay is condoned. 8.

The application stands disposed of.
