CORAM:

HON'BLE MS. JUSTICE REKHA PALLI

O R D E R

% 29.01.2018 Learned counsel for the petitioner submits that in the present petition, the limited prayer being made at this stage is for a direction to the respondent to dispose of his representation dated 21.06.2017 seeking allotment of alternate plot to him in terms of his application dated 28.04.1989. He places reliance on letter dated 3rd July, 1995 written by the respondent no.1 to the Land Acquisition Collector, Tis Hazari, Delhi, wherein a report had been sought in respect of the application made by the petitioner pertaining to his land acquired under Award No.19/86-87.

Learned counsel for the respondent submits that the respondent is still trying to search the petitioner‟s initial application claimed to have been made on 28.04.1989, but the same is still not traceable on record.

Despite opportunity, no counter affidavit has been filed by the respondent. However, keeping in view the fact that application for allotment of alternate plot is claimed to have been submitted by the petitioner almost 29 years ago and at this stage, only a limited prayer for disposal of his representation dated 21.06.2017 is being pressed by the petitioner, the respondent is directed to decide the petitioner‟s representation dated 21.06.2017 by a reasoned and speaking order within four weeks. While deciding the representation, the respondent will also take into consideration the letter dated 03.07.1995 written by the respondent to the Land Acquisition Collector. (Annexure P-2) The petition is disposed of with the above directions. JANUARY 29, 2018/aa REKHA PALLI, J
