% 02.08.2017 In paragraph 14 of the writ petition, the petitioner has accepted that he was shown the videography of his long jump test and as per the said CD he had failed. Counsel for the petitioner submits that this is factually incorrect and he would like to amend the writ petition. We would have perhaps considered the prayer of the petitioner, but find that this Court lacks territorial jurisdiction to entertain the present writ petition. The petitioner, it is apparent, had participated in the selection process initiated by the North East Railway, whose head office is located in Gorakhpur, Uttar Pradesh. The petitioner had thereafter participated in the Physical Efficiency Test, which was held in Kapurthala, Punjab. The petitioner was declared disqualified as he did not clear the long jump. We are, therefore, satisfied that no part of cause of action has arisen in Delhi.
The petitioner would be at liberty to file a fresh writ petition before the High Court having jurisdiction.
With the aforesaid observations, we refrain to entertain the present writ petition.
