The present application has been filed by the respondents stating inter alia that the writ petition may be disposed of as infructuous for the reason that after the last date of hearing i.e. on 26.09.2018, when the presence of the Officer who had passed the impugned order dated 18.07.2017, rejecting the petitioner's request for compassionate allowance, namely Commandant, 123 Bn, CRPF had been directed to remain present on the next date of hearing i.e. 15.10.2018, a decision has been taken by the respondents on 01.10.2018, sanctioning compassionate allowance to the petitioner as is admissible to him in accordance with law, w.e.f. the date of his dismissal from service i.e. from 13.10.1992.

Learned counsel for the respondents states on instructions that the amounts payable to the petitioner towards compassionate allowance will be released within four weeks from today. 3.
In view of the submission made hereinabove, no further orders are required to be passed in the writ petition which is disposed of alongwith the present application.
