CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

% 26.09.2018 Notice.

Learned APP accepts notice for respondent no. 1. Respondent no.2 Ms. Jatinder Kaur is present in Court along with her counsel and accepts notice.

She has been identified by SI Sunil Kumar of police station Govind Puri.

Respondent no.2 submits that with the intervention of common friends and neighbours, she has settled the matter with the petitioners of her own free will and without any undue force, pressure or coercion. Respondent no. 2 further says that she has no objection in case FIR No. 1277/2015 under Sections 354-A/509 IPC and sections 12/21(1) POCSO Act, registered at Police Station Govind Puri and consequent proceedings emanating therefrom are quashed against the petitioners.

Each petitioner has already deposited `10,000/- online with Kerala Chief Minister's Distress Relief Fund and receipts thereof have been produced which are taken on record. Keeping in mind the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J SEPTEMBER 26, 2018 sm
