O R D E R

% 17.02.2017 It is submitted that on the complaint of respondent no.2, FIR No.86/2014 under Sections 120B/419/420/467/468/471 IPC was registered at police station Greater Kailash against the petitioners and respondent no.3. Now, matter has been settled between them, therefore, FIR may be quashed.

Learned counsels for the respondent no.2 and respondent no.3, submit that the matter has been settled between the respondent nos.2 and 3, inasmuch as, payment has been received by respondent no.2 from the respondent no.3.

Respondent no.2 is present in Court and has been identified by SI Laxman Chaudhary PS Greater Kailash. He admits having settled the matter with the petitioners as well as respondent no.3. He further submits that he has already received the payment from respondent no.3. As regards the petitioners, it is submitted that respondent no.2 has already received `34 Lacs from the petitioners out of the total settled amount of `45 lacs.

Balance amount of `11 Lacs has been paid by the petitioners to respondent no.2 today in Court. `1 Lac has been paid in cash and `10 Lacs has been paid by way of three demand drafts, photocopies whereof have been placed on record.

Petitioners and respondent no.2 submit that they do not have any cheque in their possession pertaining to the other party. Learned counsel for the respondent no.3 also submits that the respondent no.3 has informed him that he does not have any cheque of respondent no.2 or the petitioners, regarding the present transaction.

Respondent no.2 submits that he has no objection in case the present

FIR is quashed in view of the settlement.

Keeping in mind the settlement arrived at between the parties, in the interest of justice, FIR No.86/2014 under Sections 120B/419/420/467/468/471 IPC registered at police station Greater Kailash, is quashed.

Petition is disposed of in the above terms.
