BAIL APPLN. 2570/2016 At the outset, it has been pointed out that there is some confusion since there are two FIRs in question.

Firstly, there is FIR No.222/2016 under Sections 328/ 342/ 363 IPC, wherein subsequently provisions of POCSO Act have been added. The petitioner is an accused in this case. The petitioner appears to have been granted regular bail in FIR No.222/2016. However, subsequently the

provisions of POCSO Act have been added.

There is another FIR No.237/2016, which Ms. Kolluru informs is under Section 376 IPC against the brother of the petitioner. The petitioner is also a co-accused in the said case. Provisions of POCSO Act have also been invoked in this case.

In these circumstances, learned counsel for the petitioner wishes to withdraw the present petition with liberty to move the Trial Court first. Dismissed as withdrawn with liberty as prayed for. VIPIN SANGHI, J DECEMBER 21, 2016 B.S. Rohella
