O R D E R

% 29.01.2019 On 12.10.2018, we had issued notice on the limited prayer for settlement as the appellant is an old lady. In this case, admittedly post decree of divorce, the respondent has re-married and has two children from the second marriage. It is contended by learned counsel for the respondent that the respondent is receiving a pension of Rs.22,000/- per month and paying maintenance to the appellant @ Rs.3000/- per month.

The respondent is not agreeable for any settlement. Accordingly, keeping in view the order passed on the first date of hearing when limited notice was issued to explore the possibility of a settlement, no further orders are required to be passed.

Ms.Chandra submits that the appellant would seek appropriate relief regarding maintenance in the proceedings which have already been initiated under Section 125 of Code of Criminal Procedure, 1973. G.S.SISTANI, J JYOTI SINGH, J JANUARY 29, 2019/ssc
