% 16.12.2016 Parties agree that the subject matter of the present petition, namely, the petition filed by the petitioner under section 5 and 10 of the Guardians and Wards Act being petition G.S. No.8/2012 titled Vishal Aggarwal vs. Saumya Aggarwal pending in the court of Shri Brijesh Sethi, Family Court, Dwarka be transferred to the court of Shri D.K.Sharma, Family Court, Saket.
Learned counsel for the parties submit that this matter needs expeditious disposal in view of directions of the Supreme Court dated 21.9.2015. Hence, it is urged that the request is being made for present transfer.
In view of the above, the present petition is allowed and the petition being G.S. No.8/2012 titled Vishal Aggarwal vs. Saumya Aggarwal pending in the court of Shri Brijesh Sethi, Family Court, Dwarka is transferred to the TRP.(C)166/2016
court of Shri D.K.Sharma, Family Court, Saket. Learned counsel appearing for the respondent submits that apart from the Guardianship Petition there are two other matters, namely, divorce case/counter-claim pending. He submits that it would be in the interest of justice that the same matter is also heard by the same court. Accordingly, the said divorce case/counter claim being HMA No. 363/2013 would also stand transferred to the court of Shri D.K.Sharma, Family Court, Saket. Parties to appear before the court of Shri D.K.Sharma, Family Court, Saket on 21.12.2016.
Petition stands disposed of.
