% 01.10.2018 CM APPL. 40546/2018 (Exemption) Exemption allowed, subject to just exceptions. CM(M) 1184/2018 & CM APPL. 40545 & 40547/2018 Initial submissions have been made on behalf of the petitioner. The petitioner assails the impugned order dated 10.08.2018 in Suit No. 9970/2016 of the learned trial Court whereby the learned trial Court directed the deletion of the defendant nos. 1, 2 & 3 to the Suit No. 9970/2016 in view of the factum that the property in suit qua which the suit had been filed by the petitioner herein with the prayers for grant of permanent and mandatory injunction were allowed, was indicated to have already been sold by the defendant nos. 1, 2 & 3 on 01.03.2012 prior to the institution of the suit which as per the index of the said suit placed at Annexure P-3 to the present petition is itself indicated to have been filed on 06.08.2012. Taking the same into account, it is held that there is no infirmity in the impugned order.

The petition CM(M) 1184/2018 and accompanying applications are declined.
