% 19.12.2016 Crl. M.A. 19628/2016 There is delay of 390 days in filing the appeal. To explain this delay, the only plea taken is that the delay is neither intentional nor deliberate and has occurred due to the lengthy procedure involved in taking the approval from the competent authority for filing the appeal against the order of acquittal. The grounds taken by the petitioner are totally vague. No details have been given to show that prompt steps were taken by each authority, on whose table file was placed for approval. Mere bald and general statement that delay occurred due to lengthy procedure is not sufficient to explain the delay of more than one year. Application is dismissed, consequently, appeal also goes as time barred.

Miscellaneous application is disposed of as infructuous.
