This petition under Article 227 of the Constitution of India impugns the order dated 12th May, 2017 (in CivDJ/611263/2016 of the Court of Additional District Judge-05 (West), Tis Hazari Courts, Delhi) insofar as imposing the costs on the petitioner.

A perusal of the order shows that the counsel for the petitioner on 12th May, sought adjournment for cross-examination expressing his own unpreparedness. While giving such opportunity, to compensate the witness, cost of Rs.5,000/- was imposed.

No ground for interfering with such discretionary order is made out. 6.
Dismissed.

It will however be open to the petitioner to before the learned Additional District Judge make a request for reduction / waiver of the costs. No costs.
