The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.1130/2015 registered under Sections 302/34 IPC at PS Nihal Vihar. Status report is on record.

I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 16.11.2015. All the material prosecution witnesses have since been examined. The prosecution case is primarily based upon circumstantial evidence. It is alleged that a purse containing `130/-, driving licence and other documents were recovered from the petitioner. The recovery after three days prima facie is doubtful. 3.
Considering the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the Trial Court. 4.
The bail application stands disposed of.
