HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 28.11.2017 By this petition the petitioner seeks anticipatory bail in case FIR No. 282/2016 under Sections 308/325/341/506/34 IPC registered at PS Madhu Vihar on the complaint of Sudha, wife of the petitioner. In the FIR Sudha alleged that she got married to the petitioner on 22nd November, 2015, however there was quarrel with the in-laws daily when she returned to her mother's home on 29th February, 2016. On the calling of the petitioner's family complainant had come to her matrimonial home on 8th May, 2016 at Chander Vihar and when reached the gate of her matrimonial home she was not allowed to enter. A quarrel took place wherein the petitioner's family members beat the complainant and her family members resulting in injuries to 7 persons including grievous injury to Sohanpal, the brother of the complainant.

BAIL APPLN. 1398/2017

Considering the fact that even on the complaint of the mother of the petitioner a FIR was registered and 4 persons from the family of the petitioner got injured one resulting in grievous injuries, it is apparent that there was a quarrel wherein both sides indulged in a free fight. Leaned APP on instructions from the investigating officer submits that all other persons in the two FIR are on bail. Considering the allegations, this Court deems it fit to grant anticipatory bail to the petitioner. It is therefore directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that he will join the investigation as and when directed and will not leave the country without the prior permission of the Court concerned. Petition is disposed of. Order dasti.
