% 30.10.2018 This petition has been filed under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the 'Act') seeking appointment of an Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the Partnership Deed dated 24.04.2012 executed between the parties.
The disputes having arisen between the parties, the petitioner invoked the Arbitration Agreement vide its notice dated 21.06.2018. The petitioner has also filed an application under Section 9 of the Act being OMP (I)(COMM) 310/2018 seeking certain interim relief. Counsel for the respondent, without prejudice to the rights and contentions of the respondent, submits that the respondent has no objection if an Arbitrator is appointed for adjudicating the disputes that have arisen between the parties.
In view of the above and at the request of the parties, the parties are referred to the Delhi International Arbitration Centre (DIAC), which shall appoint a Sole Arbitrator for adjudicating the disputes that have arisen between the parties. The arbitration proceedings and the fee shall be governed by the DIAC Rules. All objections of the respondent shall remain open in such arbitration proceedings.
The parties shall appear before DIAC on 19th November, 2018 at 2.00 p.m.
The petition is allowed in the above terms, with no order as to cost. Dasti.
