The petitioner had approached this Court claiming to be aggrieved by the unjustified rejection of its bid made in response to Notice Inviting Tender (NIT) dated 12.04.2017 issued by the Airport Authority of India (AAI) for certain works. This Court had required the respondents including the AAI to produce the relevant records besides filing the counter affidavit. 2.

It is stated - on behalf of the AAI which is impleaded as the main respondent, by learned counsel upon instructions that the vendor authority W.P.(C) No.6671/2017

has decided by its Regional Executive Director's decision/order dated 17.07.2017 to cancel and withdraw the entire NIT process. It is also stated that one of the petitioner's grievances that the benefits which Micro, Small and Medium Enterprises (MSME) are entitled to, would be appropriately addressed. In this respect, it is stated that the policy formulated by the Central Government pursuant to a special enactment governing the MSME, postulated separate rules for each organization and that in the case of the AAI, the rules received in principle approval by the Central Government on 24.07.2017. Learned counsel submitted that in the fresh tender to be published, the concessions, permissible to MSMEs would therefore be suitably incorporated.

It goes without saying that the petitioner is at liberty to participate and claim such benefits or concessions as are available in law, subject to fulfilment of all other tender conditions.

The writ petition has been rendered infructuous in the light of this development and is accordingly dismissed.
