The facts and circumstances of the case are similar to those in Saregama India Limited versus The Indian Singers Rights Association & Others and a batch of Appeals {RFA(OS)(Comm) No.16-18/2017} decided by judgment dated 02.11.2017. This position is agreed to by the counsel for the parties.

In these circumstances, the impugned order is hereby set aside. 3.

The parties shall appear before the learned Single Judge on 29th November, 2017 (when the other suits are now listed) for further proceedings.

It is clarified that the Court has neither examined nor considered the rival claims of the parties, urged under the Copyright Act, 1957, and leave the same to be considered by the Single Judge, uninfluenced by the observations made in this order, in accordance with law.
