ARB.P. 452/2017 Learned counsel for the petitioner submits that this petition under section 11 of the Arbitration & Conciliation Act, 1996 (hereinafter referred to as the Act) has been filed on account of the fact that the Arbitrator has not made any declaration as required by Section 12(1)(b) Explanation 2 read with the Sixth Schedule to the Act, and also on account of the fact that the fee that has been proposed by the Arbitrator is not in accordance with the Fourth Schedule of the Act.

Learned counsel for the petitioner seeks leave to withdraw this petition with liberty to take appropriate steps under the Act with regard to the above-referred objection.

The petition is accordingly dismissed as withdrawn with liberty to the petitioner, as prayed for.
