O R D E R

% 16.12.2016 The petitioners seek a direction to the respondent to consider the request for extension of time for deposit of the non-refundable upfront fees and the interest fee security deposit, as demanded by letter dated 10.11.2016. Learned counsel for the respondent submits that, by communication dated 29.11.2016, the petitioner was informed that the request for extension of time would be considered by the respondent on merits in due course only.

Learned counsel for the respondent further submits that the request for extension is pending consideration and a final decision of the competent authority will be taken and communicated to the petitioner.

In view of the above, learned senior counsel for the petitioner seeks leave to withdraw the petition with liberty to approach this WP(C) 11729/2016

Court, in case, the need so arises consequent to the decision of the competent authority of the respondent.

The writ petition is, accordingly, dismissed as withdrawn with liberty to the petitioner as prayed for.
