The learned counsel for the petitioner states that an Arbitrator has been appointed. In the circumstances, it is directed that the present petition be considered by the Arbitrator as an application under Section 17 of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act'). The interim order passed on 19.12.2016 shall continue till further orders are passed by the Arbitrator.

The respondents are at liberty to apply to the Arbitrator for vacation/modification of the interim order passed on 19.12.2016. The Arbitrator shall proceed further after due notice to the respondents. It is clarified that nothing stated in the orders passed in this proceedings may be read as an expression of opinion on the merits of the dispute and the Arbitrator shall decided the controversy including the present petition - albeit as an application under section 17 of the Act -

uninfluenced by any observations made herein. The petition is disposed of.
