% 28.05.2018 Respondent no.2 is wife of respondent no. 3; whereas respondent no. 4 is son of respondent nos. 2 and 3.
Respondent no. 5 is co-accused of petitioner who has been impleaded as a performa respondent in this petition. It is submitted that petitioners and respondent nos. 2 to 4 have settled their disputes amicably. Petitioners have already paid `1 lac to the respondent no. 2 in terms of the settlement. Petitioner has paid balance settled amount of `50,000/- to the respondent no. 2 today in Court vide a demand draft, photocopy whereof has been placed on record. Respondent nos. 2 and 3 are present in Court and have been identified by SI Anand Prakash of police
station Palam Village. They submit that their son, that is, respondent no. 4 could not come today as he is unwell. They further submit that they have got instructions from the respondent no. 4 that he has no objection in case FIR No. 153/2015 under Sections 324/34 IPC registered at police station Palam Village and the consequent proceedings emanating thereform are quashed.
Affidavits of respondent nos. 2 to 4 have also been annexed with this petition wherein they have stated that they have no objection in case proceedings arising out of FIR No. 153/2015 under Sections 324/34 IPC are quashed.
Keeping in view the settlement arrived at between the petitioners and respondent nos. 2 to 4 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
