O R D E R

% 07.08.2015 Since an order on the provisional release application has already been made and in respect thereof a fresh writ petition has been filed, this writ petition does not survive any more. However, a request has been made that the mobile phone belonging to Mr Raj Kumar who is the authorised representative of the petitioner be returned by respondent No. 1. An alternate prayer is made that in case the mobile phone and sim card are sought to be retained by respondent No. 1 for investigation purposes, a certificate be given that the sim card has been seized for investigation and that there is no objection to the petitioner or the said Mr Raj Kumar applying for another sim card of the same number. The learned counsel for respondent No. 1 states that mobile phone and sim card are required for investigation and they cannot be returned. In this eventuality we are accepting the alternate prayer and direct respondent No. 1 to give a certificate that the mobile phone and sim card have been detained for investigation purposes and that they have no objection to the petitioner applying for

another sim card bearing the same phone number from the concerned telephone company.
