O R D E R

% 14.02.2019 Special Public Prosecutor for the respondent Central Bureau of Investigation (CBI) points out that the order dated 08.10.2016 of the Chief Metropolitan Magistrate, which is under challenge, was passed on the application of the petitioner under Section 85(3) of the Code of Criminal Procedure, 1973 (Cr.P.C.), the appropriate remedy where against is an appeal under section 86 Cr.P.C.

The petitioner, at this stage, requested that she may be permitted to withdraw the present petition and instead be given liberty to approach the appropriate forum by way of appeal under section 86 Cr.P.C. The petition is dismissed as withdrawn with liberty as prayed for granted.
