O R D E R

% 08.02.2017 Learned counsel for the petitioner submits that the petitioner is in custody for the last about 9 months. Trial is underway. Statement of the prosecutrix has already been recorded wherein she has given her age as 16 years. She has also stated that she had accompanied the petitioner on her own free will. She has further deposed that she had made the statement under Section 164 CrPC at the instance of her parents.

Learned APP for the State however submits that date of birth of the prosecutrix is 2nd May, 2003. Learned counsel for the petitioner submits that during the cross examination, prosecutrix had stated that she was not aware whether her date of birth is 2nd May 2003 and volunteered that her maternal uncle had told her that she was born on the same day he got married about 16 years ago. Keeping in mind the totality of facts and circumstances, it is

ordered that petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety in the like amount to the satisfaction of trial court.

Bail application is disposed of in the above terms.

Miscellaneous applications are disposed of as infructuous. Dasti.
