O R D E R

% 21.12.2016 By way of the present petition, petitioner seeks quashing of FIR No.132/2013 under Section 135 IE Act r/w Section 379 IPC registered at PS New Friends Colony on the complaint of respondent no.2 on the ground that the parties have settled the matter. Both the petitioner and Ms. Jaya Thakuria, Senior Legal Manager of respondent no.2 are present in the court and have been identified by the learned counsels. Ms. Jaya Thakuria states that respondent no.2 has arrived at settlement with petitioner in terms whereof respondent no.2 has agreed to charge ₹1,35,000/- to the petitioner for the theft bill raised and petitioner has duly paid the same.

In view of the fact that petitioner has paid the bill raised, respondent no.2 does not want to pursue with the abovementioned FIR No.132/2013 under Section 135 IE Act r/w Section 379 IPC and proceedings thereto.

Since the parties have settled the matter, no useful purpose will be served in continuing with the above-noted FIR. There is no legal impediment in quashing the FIR in question.

Consequently, FIR No.132/2013 under Section 135 IE Act r/w Section 379 IPC registered at PS New Friends Colony and the proceedings emanating therefrom are hereby quashed. Both, Ms. Jaya Thakuria, Senior Legal Manager of the respondent no.2 and petitioner who are identified by their respective counsels have signed the order sheet in acknowledgment of their statements made in the court today.

Petition is disposed of. Order dasti.
